  • Definition
PFAS means a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom. Intentionally added priority chemical or intentionally added means a chemical that serves an intended function in the final product or in the manufacturing of the product or part of the product; chemicals present from recycled materials are not intentionally added. Ecology presumes detection of total fluorine indicates intentional addition of PFAS (above 50 ppm for the later-dated products); a manufacturer may rebut.

Notification to US EPA through the Central Data Exchange (CDX), the PFAS 8(a)(7) reporting tool (§705.35)

Persons who manufactured a PFAS, including as an importer, for commercial purposes at any period from January 1, 2011 through the end of the last calendar year before November 13, 2023 must report to EPA. §705.1(a): “This part specifies reporting and recordkeeping procedures for manufacturers (including importers) of per- and polyfluoroalkyl substances (hereafter referred to as PFAS) under section 8(a)(7) of the Toxic Substances Control Act (TSCA).” §705.5: “The requirements of this part apply to all chemical substances and mixtures containing a chemical substance (including articles) that are a PFAS, consistent with the definition of PFAS at § 705.3.” §705.18(a): an importer of an article that contains a PFAS may use a streamlined article-importer form for each year since January 1, 2011 in which the PFAS was imported in an article. PFAS is defined in §705.3 by three structural sub-structures; this check lists the rule for a product only if it contains a PFAS.
